CUT Opposes SB26-164, Regulation of Lawful Tetrahydrocannabinol Beverages

The bill establishes guidelines for the manufacture, transportation, distribution, and sale of non-alcohol beverages infused with THC, the active ingredient of cannabis products. Cannabis enthusiasts can currently smoke or eat the product. This bill regulates THC in beverages at a cost of $600k – $700k per year plus 20+ FTEs for the aforementioned guidelines and regulations and continues to bloat Colorado’s bureaucratic government.

Bill SB26-164 Summary

The bill regulates manufacture, distribution, sale, and consumption of lawful THC beverages. A “lawful THC beverage” is defined as a nonalcoholic beverage product infused with THC derived from legal hemp sources, containing no more than 10 milligrams of total THC per serving.

Hemp products manufacturers registered with the Department of Public Health and Environment may manufacture these beverages if they use approved hemp sources and comply with CDPHE rules on labeling, production, and transportation. Manufacturers may only sell to state-licensed wholesalers, not directly to retailers or consumers.

The CDPHE must adopt labeling, packaging, and consumer notice rules by January 1, 2028. Manufacturers must also adhere to hemp product testing standards.

Licensed retailers may sell lawful THC beverages after obtaining a permit. They must comply with restrictions including: not selling to individuals under 21, refusing visibly intoxicated customers, prohibiting off-premises consumption for on-site sales, preventing marijuana use on premises, and preventing mixing THC beverages with alcohol in one container.

The bill prohibits beverages made from synthetic or semi-synthetic cannabinoids and allows local governments to ban sales within their jurisdictions.
