CUT Opposes SB26-155, Increase Access Homeowner’s Insurance Enterprise

This bill establishes the Strengthen Colorado Homes Enterprise in the Division of Insurance (DOI) in the Department of Regulatory Agencies (DORA). The enterprise will charge a .5% fee on all property insurance policies to fund a grant program for resilient roofing and to analyze insurance risk in high-risk wildfire areas of the state. CUT strongly opposes this TABOR bypass that will result in $30M in fees (taxes), increased insurance costs to all property owners – all to finance grants that benefit only a few. This is not the role of government. Insurance companies can offer incentives to property owners without government involvement.

Bill SB26-155 Summary

The bill creates the strengthen Colorado homes enterprise, a government-owned business within the division of insurance that is governed by a 7-member board including the insurance commissioner, experts in home hardening and resilient roof systems, and representatives from insurance companies, consumers, and counties.

The enterprise’s primary purpose is to collect annual fees from insurers offering multiperil homeowner’s insurance policies and use those revenues to provide grants to homeowners for retrofitting residential properties with resilient roof systems. Beginning in 2027, the fee will equal 0.5% of total premiums collected by each insurer on multiperil homeowner’s insurance policies in the preceding calendar year, and insurers cannot pass this fee to policyholders.

When awarding grants, the board prioritizes primary residences and considers factors such as applicant income, roof age, home size, number of applicants, and susceptibility to extreme weather events. Fee revenue may also support grants for training and certification in resilient roof system installation. Contractors receiving grant funds are prohibited from waiving homeowner’s insurance deductibles.

Additionally, fee revenue supports studies analyzing insurance risk in high-risk wildfire areas, including market competition and program impacts on insurance availability. Starting January 1, 2027, insurers must demonstrate that savings from resilient roof installations are passed to homeowners through discounts or reduced premiums.
