CUT Opposes SB26-119, Authorize Local Electronic Ballot Return

The bill amends the “Colorado Local Government Election Code” and the “Colorado Municipal Election Code of 1965” to add authorization for special districts and municipalities to use electronic ballot return using a qualified electronic transmission system in elections under the local code. With increased and highly visible cases of electronic hacking of systems as well as specific concerns about electronic voting machines, this bill’s electronic casting of votes over networks could dramatically endanger the real or perceived validity of elections. Voters, more and more, are wanting to move away from any electronic voting so this bill is a move in the wrong direction.

Bill SB26-119 Summary

The bill amends Colorado’s local government election codes to permit special districts and municipalities to implement electronic ballot return systems. These systems must provide secure identification and authentication and transmit encrypted information over a secure network while protecting voter privacy and ballot integrity. Election officials must convert electronic returns to paper ballots for counting and storage. All electronic data from voters remains confidential. The Secretary of State will issue guidance and may establish rules for qualifying electronic transmission systems.
