Unanimous opposition by the CUT board on this resolution. This resolution claims that TABOR prevents Colorado from being a republican form of government. We could equally complain that many state agencies that enact regulations are not republican but rather bureaucratic in form and these infringe on the plenary authority of the state. Examples include DORA, CDHS, and CDPHE. This bill strikes directly at the state constitution, Article V Section 1, which reserves to the people the power to propose laws and amendments to the constitution, independent of the assembly. Using the logic of this bill, all “citizen” led initiatives and constitutional amendments should be swept away. This bill sets a precedent over every citizen led initiative where the votes of the people could be overturned by the judiciary.
