CUT Opposes HB26-1422, Security Measures for Certain Government Entities

The bill creates an Administrator of Legislative Safety for the Legislative Department and the Court Security Authority, a special purpose authority, to collect and distribute a court security surcharge for the Judicial Department. The bill addresses other issues of security at judicial and legislative facilities, and for the protection and security of elected officials and staff generally. CUT objects to many aspects of this bill. It removes current requirement for the SoS to include candidate disclosures on the SoS website. It increases the court surcharge fee by 100%. It appears to transfer authority from the judicial branch to the legislative. It increases expenditures and employee count by creating yet another authority. It moves revenue away from TABOR limitations. It uses the Safety Clause. The Fiscal Note does not indicate any historical enforcement issue that needs addressing.

Bill HB26-1422 Summary

The bill addresses security measures for the legislative department and judicial department of state government and for the governor. The legislation creates several new positions and authorities: an administrator of legislative safety for the General Assembly, renames the chief security officer to sergeant at arms, and establishes the court security authority. It expands Colorado State Patrol jurisdiction to include the governor’s mansion and clarifies their role in the capitol complex. The bill modifies campaign disclosure requirements to allow mailing addresses instead of street addresses, restricts public access to candidate disclosure statements and financial disclosures, and increases court security surcharges from $5 to $10 beginning in 2027. Additional provisions extend retaliation protections to judicial employees and expand privacy protections for elected officials and judicial employees regarding personal information online.
