CUT Opposes HB26-1326, Sunset Public Utilities Commission

This Bill extends the life of the Public Utilities Commission until 2037 and expands its mission and authorities. The PUC under the bill would be authorized to conduct private conversations outside of adjudicatory matters, and to use email in its business. The Bill directs the PUC to investigate how the state can increase participation in income-based energy assistance programs, study the finances of privately held water utilities, and study onerous new regulations on ride share companies. This summary cannot list all of the new elements of a 44-page bill. This Bill empowers bureaucratic mission creep! The PUC was originally formed to protect consumers from monopoly utilities, and now it is merely a tail being wagged by a control-centric governor and a legislature. It has become a favorite hammer for those Politicians, Bureaucrats, and Interested Parties (PBIs) under the Gold Dome who seek to control every aspect of hard-working Coloradan’s lives. The governor appointed PUC Board should be replaced by a Board elected by the people.

Bill HB26-1326 Summary

The bill implements recommendations from the department of regulatory agencies in its 2025 sunset review of the public utilities commission as follows:

– Continues the commission for 11 years to September 1, 2037
– Permits commission members to engage in nonpublic communications regarding adjudicatory matters after the evidentiary record closes, with prior notice and public disclosure of final reasoning
– Authorizes the commission to send communications by email
– Modernizes processes and provides transparency by aligning renewable energy standards, directing a study on joint procurement barriers, authorizing third-party administration of customer programs, and clarifying appeal rights for municipally owned utilities and cooperative associations
– Authorizes the commission to direct investor-owned electric utilities to use securitization as an alternative financing method
– Requires the commission to standardize income-based energy assistance programs and conduct a study on improving funding access and equity
– Prohibits impersonating transportation network company drivers and establishes penalties
– Requires transportation network companies to submit anonymized safety reports
– Expands criminal history check requirements for motor carrier drivers
– Directs a market study on intrastate contract and common carrier regulations
– Updates charter bus, taxicab, and other vehicle inspection requirements
– Updates railroad regulation requirements to align with federal law
– Modifies no-call list fees and telecommunications-related assessments
– Clarifies 911 service charge usage and establishes rate caps for penal communications services
– Exempts small natural gas pipeline operators from minimum penalty requirements
– Directs a study identifying privately owned water utilities and their financial conditions
