CUT Opposes HB26-1322, Civil Actions for Conversion Therapy Survivors

This bill creates a civil cause of action for individuals, or their estate if deceased, who suffered injury or harm from “sexual orientation or gender identity change efforts,” commonly called “conversion therapy.” It targets licensed mental health professionals, their supervisors, and those who hired the professional. This bill has no statute of limitations, allows for economic and punitive damages, and makes it easier for a plaintiff to prove in court that the conversion therapy directly caused their injury or harm. CUT unanimously voted NO on this bill, saying it looks to intimidate any counseling that doesn’t adhere to the woke progressive narrative and will have a chilling effect on freedom of speech. The ability of a deceased individual’s estate to sue, combined with no statute of limitations, makes this bill a “cash cow” for the trial lawyer association.

Bill HB26-1322 Summary

The bill establishes a cause of action for claims of injury caused by sexual orientation or gender identity change efforts against a mental health professional and allows the cause of action to be commenced at any time without limitation. The legislation applies to licensed mental health professionals conducting such efforts, as well as entities that hired or supervised them. It permits survivors or their representatives to pursue economic, noneconomic, and exemplary damages, establishing methods to demonstrate connections between the conversion therapy practices and resulting harm. The bill also defines parameters for expert witness testimony regarding these efforts and their effects.
